New Connecticut Discharge of Stormwater Regulations
Now in Effect

New State of Connecticut Stormwater Regulations require existing permits to be registered under the new regulations by April 1, 2026.

The State of Connecticut has issued updates to the permit requirements for the Discharge of Stormwater Associated with Industrial Activities. If your facility’s operations and/or activities discharge stormwater runoff into State waters, as do many boatyard and commercial waterfront activities, the new regulations are now in effect.

Although each facility is unique in regards to sources, type and volume of stormwater discharge, common marine activities subject to the regulations include pressure washing, sanding, painting, engine maintenance, material storage, and more.

Administered by the Department of Energy and Environmental Protection (“DEEP”), the updated general permit requires registration for new and existing permittees and the development and implementation of a site-specific Stormwater Pollution Prevention Plan (“SWPPP”). The new updates also include significant changes to the general permit, such as:

  • clarifications on stormwater and non-stormwater discharge authorizations and prohibitions

  • additional sector-specific definitions

  • additional stormwater control measures, best management practices

  • increased monitoring requirements

  • new corrective actions

  • new electronic reporting

  • a new online non-compliance notification reporting tool

  • recommendations for resiliency measures

  • annual report filing and facility sign requirement​

A few key dates and necessary actions include:

  • Sites that have already have permits in place are required to register for the new Industrial and Commercial Stormwater General Permits by April 1, 2026 or submit a Notice of Termination.

  • New sites are required to register at least 90 days prior to initiating an industrial discharge.

  • Permits are non-transferable.

  • Sites with new owners or operators must register within 30 days of the transfer date and existing permittees must submit a Notice of Termination.
